Terms of Service of GOURMET BROTHERS LTD
1. Information about us
We operate the website www.originalsupperbox.co.uk. We are GOURMET BROTHER LTD, a company registered in the UK.
2. Service availability
Our service is only intended for use by people residing in the United Kingdom of Great Britain (Excluding Northern Ireland and islands off of the mainland). We do not accept orders from customers outside these countries
3. Placing an Order
To place an order with us, you must be over 18 years of age, require delivery in our specified delivery area and have a credit or debit card acceptable to us in your name. We reserve the right to decline any order or to suspend your account with us at our discretion.
4. Contract with The Original Supper Box Company (GOURMET BROTHERS LTD)
This website is operated by GOURMET BROTHERS LTD. Once you have placed an order on the website we will confirm your order by sending an email to the email address you have provided. This email will list all products you have ordered, the price and delivery details. This is not an acceptance by us. A legally binding contract will only arise once we have completed delivery of the goods to you.
To enable GOURMET BROTHERS LTD to provide the Products, the Buyer will at all times;
Co-operate with the Supplier and provide any documents, information and/or materials, support and facilities required, and within reasonable time of such a request from the Supplier.
Obtain all and any licences, permission, consents and anything similar prior, to the supply of the Products and provide evidence of the same if required to do so by the Supplier. Unless specified within the Order confirmation, the costs of meeting this obligation will be the responsibility of and paid directly by the Buyer.
Comply with all statutes and statutory regulations applicable to the use and storage of the Products.
The Buyer will also comply with the Order confirmation and all and any special terms contained within that Order confirmation.
5. Refunds, Amending or Cancelling the Contract
If the Products do not comply with the Order confirmation or are faulty, then the Buyer should notify the Supplier in writing on the day of delivery at email@example.com. The Supplier will, at their sole discretion, then provide the Buyer with replacements Products, or where a replacement is not available, with a refund.
Should you wish to cancel your order after the cut off time (5pm two days prior to delivery), we may charge you in full for an amount equal to the value of your order, including any delivery cost if applicable.
Where you order goods that are unavailable for any reason, we shall notify you and you shall have the option either to wait until those goods are available again or accept a full refund within 2 days.
The Supplier reserves the right to deny any refund if the Buyer is unsatisfied with their Product due to not following the recipe instructions, adding ingredients that are not included in the box or the misuse any ingredients.
However, if the Buyer has not paid in full for the Products, or the Buyer has not complied with their obligations, then the Supplier is under no obligation to rectify any defect in respect of this Clause.
All Products sold by the supplier may not be subject to the Consumer Protection (Distance Selling) Regulations 2000. Particularly, these regulations do not apply to Products purchased by a business or food items or Produce.
6. Prices, payment and Delivery Charges
The price of the goods will be as quoted on the website at the time you confirm your order by clicking “Checkout” and will be inclusive of VAT (if applicable) or any other tax.
Unless stated in writing prior to placing an order, payment must be made in accordance with the checkout process
Where payment or any part payment is overdue (such as if there are problems with the payment method or payment does not clear for any reason or is not made in time), then the supplier will immediately cease or suspend the provision of any Products until full cleared payment is received by the Supplier.
The Supplier will charge interest on overdue payment at a rate of 4% per annum and is also entitled to recover all reasonable expenses incurred in obtaining payment from the Buyer, where any payment or part payment due to the Supplier is late. Of course, the Supplier will do everything possible to avoid such issues.
If paying by direct debit or credit card, please note that The Original Supper Box Company (GOURMET BROTHERS LTD) has appointed Barclaycard (www.barclaycard.com) to collect your payments. GOURMET BROTHERS LTD will be shown on your bank statement for these payments
Deliveries on Tuesday, Friday and Saturday morning to London postcodes (SW, SE, E, EC, N, NW, W and WC) will incur no delivery charge. Deliveries outside of these times and outside of these postcodes will be subject to a delivery charge set out at the time you checkout.
If you amend your order prior to the cut off time to increase the quantity of items already ordered, the price charged for the additional items will be the price quoted at the time you made the original order. If, however, you are adding new items to your order, the price charged will be the price quoted at the time you amend the order.
We will debit the total cost of your order, including any delivery charge or packaging cost that may be applied, from your debit or credit card at the time you place your order.
The Supplier will supply Products in accordance with the description of such Products contained within the Order confirmation. Time limits provided are estimates only. However, whilst the Supplier will use its reasonable endeavours to supply the Products, the Supplier shall not be responsible for any failure to provide or any unavialbility. We will always aim to deliver your order on the day requested by you at the time you place your order.
If nobody is available at the primary delivery address (nominated by you at the time you place your order) to take delivery of the order, and you have not nominated a secure place then the courier will leave your delivery in a safe place at their discretion. If a secure place has been listed (nominated by you at the time you place your order) then the courier will leave the delivery in the specified place. At no point do Gourmet Brothers Ltd or the nominated couriers accept liability or responsibility for the delivery once the parcel has been delivered. Gourmet Brothers Ltd and the nominated couriers contract (with the customer) is complete once the delivery has been made irrespective if the customer is at the premises or not.
In the event that nobody is available to take delivery of your order at your primary delivery address, you ask us to leave your goods unattended at a secure place or you do not enter any delivery instructions, GOURMET BROTHERS LTD expressly disclaims all liability that may arise in consequence of the delivery being left unattended, including, without limitation, theft, tampering or contamination or degradation of Product, however caused.
The risk of the Product passes to the Buyer on delivery of the Product. The Supplier disclaims all liability for Products left out longer than the recommended 5pm point on the day of delivery.
The Supplier shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside the Suppliers control including but not limited to, acts of God, accidents, war, fire, strikes, lock outs, failure of communications including telecommunications or computer systems, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Supplier shall be entitled to a reasonable extension of its obligations or liability to the Buyer shall be limited to the price of the goods ordered and the cost of delivery (if applicable).
8. Customer Accounts
You are required to set up an online account with us to make each visit to our website and order easier. When you set up an account you will be given a user name and password to use each time you place an order with us.
You are responsible for all activity on your account. You should ensure that your username and password are known only to you and that access to your computer is restricted to prevent any unauthorised use of your account. You must inform us immediately if you believe your password has become known to anybody else or has been or may be used in an unauthorised manner.
Please ensure that the information you provide us with is correct and up-to-date and notify us as soon as possible of any changes.
We are committed to offering you the best produce and service and guarantee that the quality of all goods you order from us. You must inspect the goods immediately upon delivery and, in the event that you are dissatisfied in any way with either our service or the quality of the goods you receive, let us know promptly via firstname.lastname@example.org.
Complaints in respect of service will be reviewed by our customer services team and we aim to respond to you within 1 working day whenever possible.
Complaints in respect of the quality of the goods you receive will be forwarded to our product team for review and we aim to respond to you within 1 working day whenever possible.
10. Gourmet Brothers LTD Liability
GOURMET BROTHERS LTD will not be liable for any indirect or consequential loss or damage of loss of profits arising out of our supply or failure to supply the goods to you.
Nothing in this agreement shall in any way limit our liability for death or personal injury resulting from our breach of contract, tort or negligence nor limit any legal rights you have as a consumer.
Some of our products may contain traces of nuts and other allergens as the products are packaged in the same premises. We will do our best to ensure any products that contain these products are clearly labelled, however it is your responsibility to check with us should you be unsure of the product contents. The goods are sold to you on the basis that you are a consumer, therefore we will not be liable for any special losses that you might suffer using, distribution or reselling the goods as part of a business.
The Supplier shall not be liable for goods once they have been delivered to the address or secure place stated in your order. Our packaging is designed to ensure our produce reaches you in perfect condition but it is the Buyers responsibility to ensure that all perishable goods are refrigerated as soon as possible upon receipt. Further, if you or a third party moves, transports or delivers the goods to any other address following our delivery, the Supplier shall not be liable for anything that that third party might do to the goods or any subsequent deterioration in the produce
Please note that we will do our best to ensure that access to our website is uninterrupted and that transmissions are error-free but, given the nature of the internet, this is not something that we are able to guarantee. There may be occasions where access is suspended or restricted so that we can undertake repairs, maintenance or improvements. We will keep such occasions to a minimum and endeavour to restore full access as soon as we can.
These terms and conditions set out the entire agreement between the Supplier and the Buyer. Any failure by the Supplier to enforce any of our rights under this Agreement shall not prejudice the Suppliers entitlement to rely on any of the Suppliers rights in the future.
The Supplier shall not be liable for delays or failures to perform our obligations if that delay of failure arises from events beyond our reasonable control.
The Supplier reserves the right to change our website, policies and terms and conditions at any time but this shall not affect the terms and conditions prevailing at the time the Buyer makes a purchase.
This Agreement is governed by the laws of England and Wales and both parties hereby submit to the exclusive jurisdiction of the English courts.
